THE HONOURABLE SRI JUSTICE A. RAJASHEKER REDDY WRIT PETITION No.32779 of 2010 ORDER:

This writ petition is filed with the following prayer: "...to issue a writ or direction preferably writ of mandamus declaring the action of the respondent in not considering the claim of the petitioner vide file No.112/1467/85 for grant of pension under "Swatantra Sainik Samman Pension Scheme 1980" as illegal, arbitrary and violative of principles of natural justice and consequently direct the respondent to grant pension to the petitioner from the date of the scheme and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."

Learned counsel for the petitioner submits that the respondents have filed additional counter-affidavit stating that the case of the petitioner was rejected vide Ministry's letter No.112/1467/85-FF (HC), dated 06.03.2012 and in view of the same, he requests that the writ petition can be disposed of with liberty to challenge the said rejection order.

Recording the above said submission, the writ petition is disposed of granting liberty to the petitioner to challenge the rejection order, in accordance with law.

Miscellaneous petitions pending, if any, shall stand closed. No order as to costs.
