Heard learned counsel for the petitioner and perused the order dated 05-07-2018 in Criminal Petition No. 6930 of 2018, wherein this Court in similar case has given liberty to the petitioner to file a petition under Section 70 (2) of Cr.P.C. before the trial Court, in which case the trial Court shall dispose of the same on the same day.

As the present matter also stands on the same footing, this petition is disposed of with a direction to the petitioner to approach the trial Court and move an application under Section 70 (2) of Cr.P.C., in which case the trial Court shall, after serving notice on the respondent-complainant, dispose of the said petition on merits on the same day.
