THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITON No.9398 of 2015

ORDER

The petitioner/de facto complainant filed this petition under Section 439(2) Cr.P.C. seeking to cancel the anticipatory bail granted to her husband i.e., second respondent/A1, vide order dated 01.07.2015 in Crl.P.No.5780 of 2015.

2. Heard and perused the material on record.

3. The second respondent/A1 was involved in Cr.No.155 of 2014 of Uravakonda Police Station, Ananthapur, registered for the offences under Sections 313, 498-A IPC and under Sections 3 and 4 of Dowry Prohibition Act read with Section 34 IPC.

4.

The main grievance of the petitioner is that the second respondent/A1 has committed serious offences by causing miscarriage and attempted to kill her and without considering the same, this Court granted anticipatory bail to him.

5. It is not the case of the petitioner that after granting bail, A1 is interfering with the investigation and threatening her for lodging the complaint. Hence, this Court is not inclined to interfere with the order of granting anticipatory bail to the second respondent/A1.

6. Accordingly, the Criminal Petition is dismissed. _______________ RAJA ELANGO, J 21st September, 2015 sj
