HONOURABLE SRI JUSTICE U.DURGA PRASAD RAO Criminal Revision Case No.833 of 2006 ORDER:

This Criminal Revision Case is filed by the petitioner/defacto complainant challenging the order dated 16.03.2006 in S.C.No.223 of 2004 passed by the III Additional Sessions Judge, Kadapa against framing charge under Section 304 Part II r/w 34 IPC against Accused Nos.1 to 4 instead of Section 302 IPC.

2) Notices served on the respondents but there is no representation on their behalf.

3) When the matter came up for hearing, this Court called for the stage of the S.C.No.223 of 2004 since there was no stay in this revision.

4) Learned Principal Sessions Judge, Kadapa submitted report dated 06.02.2018 stating that S.C.No.223 of 2004 was originally pending on the file of III Additional Sessions Court, Kadapa and later it was transferred to the Court of I Additional Sessions Judge as per the proceedings of this Court in ROC No.1847/E.2/2016 dated 25.11.2016 and 14.12.2006, consequent to the shifting of III Additional District Judge's Court from Kadapa to Rajampet. He stated that S.C.No.223/2004 was disposed of on 05.12.2017 by the I Additional Sessions Judge, Kadapa and A.1 to A.4 were acquitted for the offence under Section 304 Part II r/w 34 IPC.

5) In view of the said information, this Criminal Revision Case is dismissed as infructuous.

As a sequel, miscellaneous applications pending, if any, shall stand closed.
