THE HON'BLE SRI JUSTICE V. RAMASUBRAMANIAN AND THE HON'BLE SRI JUSTICE G. SHYAM PRASAD WRIT APPEAL No. 1212 of 2016 JUDGMENT: (Per VRS,J) Aggrieved by the dismissal of their writ petition, challenging an order of suspension, the writ petitioners are before us. 2.

Heard Mr. P. Sridhar Rao, learned counsel for the appellants. Smt. K. Udaya Sri, learned counsel, takes notice for the respondentCorporation. 3.

The order of suspension is dated 28.09.2016. It has been passed by the Chairman and Managing Director of the respondentCorporation purportedly in public interest. Though the order does not speak out the reasons, the subject column in the order shows that there were allegations of submission of fake/forged documents for obtaining house building advance. Therefore, the learned Judge was right in refusing to interfere, at this stage. 4.

It is contended by the learned counsel for the appellants that the appellate authority had placed the appellants under suspension depriving them of an opportunity of appeal, and that much before the

VRS,J & GSP,J WA No.1212 of 2016 order of suspension, the appellants had pleaded for the change of the property.

The first contention is unacceptable, since the logic that an appellate authority cannot pass the order, may apply to an order of punishment but not to a suspension in contemplation of an enquiry into grave charges. The second contention is also unacceptable, since it is on merits, into which, we cannot go at this stage. Therefore, the Writ Appeal is dismissed.
