THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.7535 OF 2022 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/A1 in connection with Crime No.130 of 2022 on the file of C.C.S. Police Station, Hyderabad, Hyderabad District, registered for the offences punishable under Sections 406, 419, 420, 468, 471 read with 34 of the Indian Penal Code.

Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State and perused the record.

The case against the petitioner is that he is a practicing advocate; and that he induced the defacto complainant stating that an investment of Rs.20 crore would fetch an amount of Rs.4 crore, within 24 hours. He introduced A2 who is alleged to be an employee of RBI. Both the petitioner and A2 have colluded to cheat the defacto complainant. The police after registration of crime conducted investigation and seized part of the amount of nearly Rs.16 crores.

It is the allegation of the prosecution that Rs.1 crore was taken by this petitioner.

Keeping in view the age of the petitioner being 69 years and is also in jail since 09.07.2022 and since the major part of the investigation is complete and the amount has been seized, this petitioner can be granted the relief of bail subject to the following conditions:

i) The petitioner/A1 shall execute personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with two sureties for a like sum each to the satisfaction of XII Additional Chief Metropolitn Magistrate, Hyderabad. ii) The petitioner/A1, after release shall appear before the concerned Station House Officer, on every Monday and Thursday between 10.00 A.M. to 1.00 P.M. for a period of three months or till filing of charge sheet whichever is earlier, for the purpose of investigation.

iii) The petitioner/A1 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, pending if any, shall stand closed.
