HONOURABLE SRI JUSTICE S.RAVI KUMAR C.M.A.No.906 OF 2004 JUDGMENT:

This C.M.A. is preferred against the orders dated 11th September, 2002 in I.A.No.2667 of 2000 in O.S.No.98 of 1998 filed under Order 9 Rule 13 of 151 CPC to set aside the exparte decree dated 30-61998. It is represented that along with the petition to set aside exparte decree, the petition under Section 5 of Limitation Act to condone delay was filed in I.A.No.39 of 2000 in O.S.No.98 of 1998 and the same is dismissed and appellant herein preferred revision to this court in C.R.P.No.4903 of 2002 and the same is dismissed on merits on 18th March, 2004 and in view of the same, present appeal has become infructuous.

Considering the submission of the advocates appearing for the parties, this C.M.A. is dismissed as infructuous. No costs.

As a sequel to the disposal of this appeal, the Miscellaneous Petitions, if any, pending, shall stand dismissed.
