2018-07-04S.V.Bhatt2 pages

HON'BLE SRI JUSTICE S.V.BHATT W.P.No.22740 OF 2018 ORDER:

Heard Mr.E.Venkat Reddy for petitioner.

The petitioner aggrieved by the grant of pattadar passbook/ title deed in passbook No.T02020020115 has filed the instant writ petition. According to petitioner, he is the owner and possessor of Ac.1-16 gts in Sy.No.41/ AA/ 2 of Meerjapuram Village, Dharur Mandal, Jogulamba Gadwal District. The petitioner, as Annexure P-2, filed notice issued in Form No.11 dated 23.03.2018. Respondent No.4 called upon the petitioner to produce documents in support of his claim for title and possession. One of the grievances is - without proper enquiry, the pattadar passbook is issued.

Mr.Venkata Reddy, after arguing the writ petition for some time, takes note of the objection raised by the Assistant Government Pleader that the petitioner can work out statutory remedies of either appeal or revision under the A.P. Rights in Land Pattadar Passbooks Act. This Court is satisfied that the petitioner, by canvassing the prayer made in the writ petition, can effectively work out either the remedy of appeal or revision and this Court does not entertain the writ petition. However, liberty to work out the statutory remedies is granted.

The writ petition is, accordingly, dismissed. There shall be no order as to costs.

Miscellaneous petitions, if any, pending stand closed. ___________ S.V.BHATT,J 04th July, 2018 Lrkm
