THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.9430 OF 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused No.1 in Crime.No.147 of 2023 on the file of Borabanda Police Station, Hyderabad, registered for the offence under Section 306 of IPC.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State and perused the record.

The case of the prosecution is that the deceased is the wife of this petitioner. She committed suicide. The case is that she was having hearing problem and the petitioner did not heed to her repeated requests regarding gossiping about her hearing problem in the relations. The deceased tried to contact the petitioner over phone. However, the call could not get through. Thereafter, the petitioner received a phone call that the deceased has

locked herself in the room and is not opening the room. Later, she found dead as she committed suicide by hanging.

The petitioner is in jail since 25.08.2023. As seen from the remand report, most of the material witnesses are examined, petitioner can be grated the relief of regular bail, subject to following conditions:

i) The petitioner/Accused No.1 shall execute personal bond for a sum of Rs.25,000/- (Rupees twenty five thousand only) with two sureties, for a like sum each to the satisfaction of II Additional Metropolitan Sessions Judge, Hyderabad.

ii) The petitioner/Accused No.1 after release shall appear before the concerned Station House Officer at 10:00 a.m. on every Monday for a period of eight weeks for the purpose of investigation and thereafter, as and when required.

iii) The petitioner/Accused No.1 shall abide by the other conditions stipulated under Section 437(3) of Cr.P.C.

Accordingly, this Criminal Petition is allowed.

Miscellaneous applications, pending if any, shall stand closed.
