HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY WRIT PETITION No. 8703 OF 2007 O R D E R:

This Writ Petition is filed under Article 226 of the Constitution of India declaring the action of the respondents in not following the law laid down by the Apex Court in Excise Superintendent, Malakapatnam Vs. KBN Vishweshwar Rao1 and not allowing the petitioner to attend the interview for the post of Sub-staff (Class-IV) and filling up the posts through Employment Exchange only as illegal, arbitrary and consequently direct the respondents to issue call letter to the petitioner and allow the petitioner to appear for the interview for the post of Sub-staff (Class-IV) and consider him for appointment without insisting upon that his name should be sponsored by the Employment Exchange.

Counsel appearing for petitioner Smt K. Udaya Sri drawn the attention of this Court to the interim order dated 26.4.2007 granted by this Court in WPMP No.11153 of 2007, wherein this Court issued a direction to the respondents-Bank to interview the petitioner for the post of Sub-staff (Class-IV) scheduled to be held during last week of April, 2007 or any other subsequent date.

In pursuance of the interim direction, the respondents interviewed the petitioner for the post of Sub-staff (Class-IV), 1 1996 (6) SCC 216

MSM,J W.P.No. 8703 OF 2007 therefore, no further orders are required to be passed in this Writ Petition.

Accordingly, the Writ Petition is disposed of recording the submission made by Smt K. Udaya Sri, counsel appearing for petitioner. There shall be no order as to costs.
