THE HON'BLE SRI JUSTICE S.V.BHATT W.P.No. 41315 of 2016 ORDER :

Heard Mr.Janaki Rami Reddy for petitioners and Mr.Seshadri for 5th respondent - Gram Panchayat.

Mr.Seshadri, on instructions, submits that the Gram Panchayat is undertaking underground drainage works and the encroachments of the street alone are directed to be removed by respective occupants of those encroachments. The private property beyond the alignment as per 1964 Street Survey is not touched by the Gram Panchayat. He further submits that petitioners can be given three days time from today to submit explanation to the notice impugned in the writ petition and the 5th respondent - Gram Panchayat will consider, fix the boundaries as per the Street Survey and communicate the same to petitioners.

The statement is placed on record. The petitioners are given three days time from today to submit explanation to the notice impugned in the writ petition by giving the details of their property etc.

The 5th respondent is directed to juxtapose the property details with the Street Survey and communicate the decision whether the construction of house is an encroachment or otherwise within a further period of seven days therefrom. Till a decision is communicated, the 5th respondent is directed not to carry out the demolition threatened in the notice impugned in the writ petition.

The Writ Petition is disposed of with the above observations. No order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand disposed of.

The learned counsel are permitted to communicate the oral order to respective parties for timely action.
