HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN Writ Petition No.27594 of 2009 ORDER:

The relief sought for in this Writ Petition is to declare the action of the 1st respondent, (as communicated by the 2nd respondent in its proceedings dated 04.12.2009), in unilaterally vetoing the petitioner's highest bid to be the licencee for collection of tonsured human hair at the 2nd respondent's Kesakhandanasala for a period of one year i.e from 01.02.2010 to 31.01.2011, as illegal and arbitrary. A consequential direction is sought to the first respondent to confirm the petitioner's bid by granting licence for collection of the tonsured human hair, at the 2nd respondent's Kesakhandanasala, for a period of one year i.e from 01.02.2010 to 31.01.2011. This Court initially granted an interim order in WPMP No.35933 of 2009 dated 18.12.2009 directing the respondents not to finalize the auction until further orders.

On a petition being filed to vacate the interim order, a Learned Single Judge of this Court, by order dated 25.01.2010, vacated the interim order holding that the petitioner did not comply with the tender conditions. The contract is for a period of one year i.e from 01.02.2010 to 31.01.2011. As this period expired nearly seven years ago, the cause in the Writ Petition does not survive necessitating any further adjudication by this Court, and the Writ Petition has become infructuous. The Writ Petition is, accordingly, dismissed as infructuous. The Miscellaneous Petitions pending, if any, shall also stand dismissed. No order as to costs.
