THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No. 7505, 7536 and 7537 of 2022 COMMON ORDER:

These Criminal Petitions are filed under Section 438 of Cr.P.C. by petitioner/A1 in Crl.P.No.7505/2022 by petitioner/A2 in Crl.P.7536 of 2022 and by petitioner/A3 in Crl.P.No.7537 of 2022, seeking bail in the event of their arrest in connection with Crime No.367 of 2022 on the file of Panjagutta Police Station, Hyderabad, registered for the offences punishable under Sections 324, 342, 363, 386, 504 and 506 read with 34 of Indian Penal Code.

Heard learned counsel for the petitioners and learned Assistant Public Prosecutor for the respondent-State and perused the record.

The case against these petitioners is that the petitioner in Crl.P.No.7505/2022 is the first accused who lent an amount of Rs.3 crores and entered into an agreement on 01.02.2022, pursuant to the said transaction, in the process of repaying the said amounts it is alleged that the defacto complainant was beaten by all these petitioners.

Learned Assistant Public Prosecutor submits that the amounts were withdrawn from the ATM, for which reason, the petitioners cannot be granted the relief of Anticipatory Bail. 5.

Learned Counsel for the petitioner submits that there are several other cases pending against the defacto complainant, for the reason of taking money from different people and not repaying them. The petitioners also filed two FIRs bearing No.Crime No.212 of 2021 and Crime No.95 of 2021, registered by Choppadandi Police Station and Mandamarri Police Station, respectively. 6.

In the said circumstances, when there are monetary disputes in between the parties and the alleged incident is pursuant to the said money transactions and in relation to the said money transactions, these petitioners can be granted the relief of Anticipatory bail in the event of their arrest, subject to the following conditions:

1) The petitioners/A1 to A3 are directed to surrender before the Station House Officer, Panjagutta Police Station, Hyderabad, within a period of ten days from the date of this order. On such surrender, the said Station House Officer shall release the petitioners/A1 to A3 on bail, on their executing personal bonds for a sum of Rs.50,000/- (Rupees fifty Thousand only) each with two sureties for a like sum each to his satisfaction.

2) On such release, the petitioners/A1 to A3 shall appear before the concerned police on every Monday, Wednesday and Friday, between 10.30 to 1.00 P.M. for a period of four weeks, for the purpose of investigation.

3) The petitioners/A1 to A3 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.

Accordingly, all the Criminal Petitions are allowed. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
