THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.9385 OF 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused No.5 in Crime.No.86 of 2023 on the file of Yedapally Police Station, Nizamabad District, registered for the offences under Sections 147, 148, 120(b), 307 and 302 r/w. 149 of IPC.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State and perused the record.

The case of Yedapally Police is that this petitioner along with 8 others formed into unlawful assembly and in retaliation to murder committed by the deceased, the deceased was attacked. The said incident happened on 01.06.2023. All the other accused were arrested. 4.

Learned counsel appearing for the petitioner would submit that even according to the remand report, major

part of the investigation is complete, 30 witnesses were examined, in fact all the accused who are A-1 to A-4, A-6 to A-9 were released on bail by the trial Court. 5.

The said release of other accused was not disputed by the learned Additional Public Prosecutor.

Keeping in view that major part of the investigation is complete and all the other accused are released on bail, the prayer for grant of regular bail can be considered, subject to following conditions:

i) The petitioner/Accused No.5 shall execute personal bond for a sum of Rs.50,000/- (Rupees Fifty thousand only) with two sureties for a like sum each to the satisfaction of Additional Judicial First Class Magistrate at Bodhan.

ii) The petitioner/Accused No.5 after release shall appear before the concerned Station House Officer at 10:00 a.m. on every Monday and Wednesday for a period of eight weeks and thereafter, as and when required for the purpose of investigation.

iii) The petitioner/Accused No.5 shall abide by the other conditions stipulated under Section 437(3) of Cr.P.C.

Accordingly, this Criminal Petition is allowed.

Miscellaneous applications, pending if any, shall stand closed.
