THE HON'BLE SRI JUSTICE A. ABHISHEK REDDY WRIT PETITION No.20865 of 2006 ORDER:

This Writ Petition of Certiorari is filed seeking to call for the records pertaining to Award dated 04.02.2005 passed by the Central Industrial Tribunal-cum-Labour Court in I.D.No.228 of 2002 and quash the same. Learned counsel for the petitioner has stated that vide impugned order dated 04.02.2005, the learned Labour Court has granted liberty to the petitioner Company to refer the matter in writing to the District Collector for cancellation of the Caste Certificate issued in favour of respondent No.1 herein. Pursuant to the same, the petitioner-Company has referred the matter to the Collector & District Magistrate, Medak, Sangareddy District, who vide proceedings bearing No.C2/10302/2006, dated 28.01.2011, duly following the impugned order, has nullified the caste certificate issued to respondent No.1 herein.

In the above backdrop, the Writ Petition is allowed and the award dated 04.02.2005 passed by the Central Industrial Tribunal-cum-Labour Court in I.D.No.228 of 2002 is hereby set aside, however, leaving it open to respondent No.1 to challenge the proceedings of the Collector & District Magistrate, vide No.C2/10302/2006, dated 28.01.2011.

Miscellaneous petitions, if any, pending shall also stand closed. No costs.
