THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.7510 OF 2022 ORDER:
This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner who is arrayed as Accused No.2 in Crime No.236 of 2022 on the file of Station House Officer, Yacharam Police Station, Rachakonda registered for the offences punishable under Sections 498-A and 306 read with Section 34 of Indian Penal Code and Sections 3 and 4 of Dowry Prohibition Act. 2.
Heard learned counsel for the petitioner/Accused No.2 and learned Assistant Public Prosecutor for the respondent-State. Perused the record.

The case of the prosecution against the petitioner who is arrayed as Accused No.2 is that he is the brother of Accused No.1. Accused No.1 married the deceased and they were blessed with three children. The deceased suspected that Accused No.1 was having an affair with another woman, as such there were constant fights between them and the deceased subjected to mental and physical harassment by Accused No.1 and others, for which reason
and also for the reason of demand for additional dowry the deceased committed suicide.

Learned Assistant Public Prosecutor submits that the investigation is complete, charge sheet is already filed. 5.
The present petitioner is the brother of Accused No.1. An omnibus allegation was made against this petitioner that he supported the Accused No.1 in demanding additional dowry, in the said circumstances, the petitioner/Accused No.2 can be granted the relief of regular bail.

Accordingly, the Criminal Petition is allowed and the petitioner/Accused No.2 is granted bail subject to the following conditions:
i) The petitioner/Accused No.2 shall execute personal bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties for a like sum each to the satisfaction of XXVI Metropolitan Magistrate, Rachakonda at Ibrahimpatnam.
ii) The petitioner/Accused No.2 shall appear before the concerned Court on every date of hearing without fail, failing which the prosecution is at liberty to move for cancellation of bail granted to this petitioner/Accused No.2.
iv) The petitioner/Accused No.2 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C. Miscellaneous applications, pending if any, shall stand closed. _____________ K.SURENDER, J Date: 30.08.2022 ns
