HON'BLE SRI JUSTICE D.V.S.S. SOMAYAJULU IA Nos.2 and 3 2018 and AS No.1096 of 2018 JUDGMENT:

This appeal is filed against the judgment and decree dated 16.03.2014 in OS No.680 of 2014 passed by III Additional District Judge, Guntur.

IA No.2 of 2018 is filed to permit the GPA holderN. Srinivasa Rao to appear and represent on behalf of the appellant for recording compromise. The original general power of attorney executed by the appellant in favour of N. Jhansi Lakshmi is filed. The GPA holder is given the power to compromise and withdraw the case.

IA No.3 of 2018 is filed to record the terms and conditions of the compromise.

Both the learned counsel are present. The GPA holder representing the appellant is also present. The first respondent is also present. The photo copies of Aadhar cards are filed in proof of their identity, which were countersigned by the respective counsels. On enquiry, both the parties state that they have understood the terms and conditions of the compromise and they have signed the same. The learned counsel appearing for the petitioner/appellant states that he is acquainted with the facts and the signature of Smt. N.

Jhansi Lakshmi, who has executed the General Power of Attorney in favour of N. Srinivasa Rao.

Both the parties appear and state that the terms and conditions of the contract were entered into of their own free will and volition. The first respondent acknowledges the receipt of a total sum of Rs.3,50,000/- (Rupees Three Lakhs Fifty Thousand only).

In this view of the matter, the compromise is recorded. A copy of the compromise signed by both the learned counsel and the parties shall form a part of the judgment and decree whenever the same is issued. In the result, IA Nos.2 and 3 are allowed.

Consequently, the appeal is disposed of in terms of the compromise. No order as to costs.

Miscellaneous petitions, if any, pending in this appeal shall also stand closed.
