THE HON'BLE SRI JUSTICE C.PRAVEEN KUMAR WRIT PETITION No. 21874 of 2016 ORDER :

Heard the learned counsel for the petitioner and Sri A.Panduranga Rao, learned Standing Counsel appearing for respondent No.2. At their request, the Writ Petition is being taken up for disposal at the admission stage.

2. The prayer of the petitioner in this case is as under: "...to issue a Writ, Order or Direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondent No.2 in demanding the petitioner to vacate and handover the petitioner's house property bearing D.No.17-2-1/12, Ademmadibba, Seethammapeta, Rajamahendravaram, East Godavari District, in an extent of 200 sq. yds., which is in her possession and enjoyment for more than 30 years, without issuing any Notice, as illegal, arbitrary and in violation of the Principles of Natural Justice & Article 14 of The Constitution of India and consequently direct the respondent No.2 not to interfere with the peaceful possession and enjoyment of the petitioner over the property bearing d.No.17-21/12, Ademmadibba, Seethammapeta, Rajamahendravaram, East Godavari District, in an extent of 200 sq. yds., and pass..."

3. Though various grounds are urged in the Writ Petition, learned counsel for the petitioner states that respondent No.2 authorities are trying to evict the petitioner from the subject land without following the due process of law. The learned Standing Counsel appearing for respondent No.2

states that if the aforesaid land is sought to be acquired, the respondent No.2 authorities will follow due process of law.

Recording the said statement, the Writ Petition is disposed of directing the respondents not to evict or dispossess the petitioner from house bearing D.No.17-2-1/12, Ademmadibba, Seethammapeta, Rajamahendravaram, East Godavari District, in an extent of 200 square yards without following due process of law.

Pending miscellaneous petitions, if any, in the Writ Petition shall stand closed in the light of this final order. No order as to costs.
