THE HON'BLE THE CHIEF JUSTICE SRI THOTTATHIL B. RADHAKRISHNAN TRANSFER CIVIL MISCELLANEOUS PETITION No.686 OF 2016 ORDER:

This is an application for transfer of M.O.P.No.70 of 2016 from the Court of the Senior Civil Judge, Adoni, Kurnool District to the Court of the Family Judge, City Civil Courts, Hyderabad, which is filed by the respondent/husband, for restitution of conjugal rights. The petitioner/wife seeks transfer of that case. 2.

When this matter came up for hearing on 27.10.2016, this Court issued notice before admission and passed an order of interim stay. That stay was granted for a limited period of time and thereafter, the stay has not been extended.

Though notice has been taken on the respondent to the address as shown by him in the application for restitution of conjugal rights, he is not responding.

I am satisfied that sufficient cause has been shown for transfer of the case from a place far away from Hyderabad to the place of residence of the petitioner/wife.

In the result, the Transfer Civil Miscellaneous Petition is allowed transferring M.O.P.No.70 of 2016 from the Court of the Senior Civil Judge, Adoni, Kurnool District, to the Court of the Family Judge, City Civil Courts, Hyderabad.
