THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.7720 OF 2022 ORDER:
This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/A2 in Crime No.195 of 2022 on the file of Kulsumpura Police Station, Hyderabad, registered for the offences punishable under Sections 8(C) read with 20(b)(ii)(B) of NDPS Act.

Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State and perused the record.

The case of the prosecution is that this petitioner and two others were found in possession of 4 Kgs. of Ganja. 4.
On instructions, learned Assistant Public Prosecutor submits that there are no other cases pending against this petitioner. However, he is resident of Karnataka State and some stringent conditions can be imposed in the event of granting bail to this petitioner.

Since the contraband seized is 4 Kgs. from three accused which is less than commercial quantity and since there are no
other cases pending against this petitioner, this petitioner can be granted the relief of bail subject to the following conditions: i) The petitioner/A2 shall execute personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties for a like sum each among which one is local and the other is native, to the satisfaction of XVI Additional Chief Metropolitan Magistrate Court at Hyderabad.
ii) The petitioner/A2, after release shall appear before the concerned Station House Officer, every Monday between 10.00 A.M. to 1.00 P.M. for a period of six weeks and thereafter as and when required, for the purpose of investigation.
iii) The petitioner/A2 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, pending if any, shall stand closed.
