THE HON'BLE SRI JUSTICE T.AMARNATH GOUD CRIMINAL PETITION No.7620 OF 2019 ORDER:

The petitioners, who are Accused Nos.1 & 2, filed the present application under Sections 437 and 439 of Criminal Procedure Code 1973, seeking to grant bail to them in Crime No.132 of of Atmakur Police Station, Warangal Commissionerate, which was registered for the offence punishable under Section 8 (c) read with 20 (b) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short, 'NDPS Act').

The allegation against the petitioners/A-1 & A-2 is that they were found in possession of dry ganja weighing about 24.7 kgs at Katakshapur cross roads, at about 10.00 hours on 15.09.2019.

Heard the learned counsel for the petitioners/A-1 & A-2 and the learned Additional Public Prosecutor appearing for the respondent-State.

Learned counsel for the petitioners/A-1 & A-2 would submit that the petitioners have been falsely implicated in this case; that the petitioners are in judicial custody since 16.09.2019; that no contraband is seized from the possession of the petitioners/A-1 & A-2 and hence, he prays to grant bail to the petitioners/A-1 & A-2.

On the other hand, learned Additional Public Prosecutor representing the State vehemently opposed the bail application. 6.

For the time being, this Court feels that it is not a fit case to interfere since A-2 is already having track record of conducting such trading in prohibited products like Ganja and narcotic drugs and A-1 is along with him. In view of the same, for the present, this Court is not inclined to consider the application of the petitioners/A-1 & A-2. Hence, the petition is liable to be dismissed.
