THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.9387 OF 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused No.3 in Crime.No.244 of 2023 on the file of Golconda Police Station, Hyderabad, registered for the offence under Section 8(c) r/w. 20 (b) (ii) (C) of Narcotic Drugs and Psychotropic Substances Act, 1985 (for short 'the NPDS Act') and 29 of NDPSAA.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State and perused the record.

On 22.08.2023, the SI of Police, Golconda apprehended A-1 and seized 22 kgs of ganja and the vehicle in which they were travelling. On the basis of confession of A-1, the Police arrested this petitioner and found 0.535 kgs of ganja and cash of Rs.25,13,000/-.

Learned counsel appearing for the petitioner would submit that small quantity is 1 kg. and on the basis of 0.535 kgs. of ganja, the offence would be bailable offence and punishable upto 6 months.

However, keeping in view that the quantity of contraband seized is less than small quantity and the implication is basis of confession of A-1, this petitioner can be granted the relief of regular bail, subject to following conditions:

i) The petitioner/Accused No.3 shall execute personal bond for a sum of Rs.50,000/- (Rupees Fifty thousand only) with two sureties for a like sum each to the satisfaction of I Additional Metropolitan Sessions Judge, Hyderabad.

ii) The petitioner/Accused No.3 after release shall appear before the concerned Station House Officer at 10:00 a.m. on every Monday and Wednesday for a period of eight weeks and thereafter, as and when required for the purpose of investigation.

iii) The petitioner/Accused No.3 shall abide by the other conditions stipulated under Section 437(3) of Cr.P.C.

Accordingly, this Criminal Petition is allowed.

Miscellaneous applications, pending if any, shall stand closed.
