THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No. 7521 of 2022 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by petitioners/A1 & A2 in connection with Crime No.306 of 2022 on the file of Bhupalapally Police Station, Jayashankar Bhupalapally District, registered for the offences punishable under Sections 306 read with 34 of the Indian Penal Code.

Heard learned counsel for the petitioners and learned Assistant Public Prosecutor for the respondent-State and perused the record. 3.

The case against the 1st petitioner is that the defacto complainant lodged a complaint before the police stating that his sister was married two months prior to her committing suicide; that after marriage the 1st petitioner who was in love with the deceased informed the deceased that he would marry her in the event of her getting divorce from her husband. Accordingly, the deceased came back. However, the 1st petitioner refused stating that he will not marry her though she has left her husband, for which reason she had committed suicide by consuming pesticide. The case against the 2nd petitioner is that he has helped Accused No.1.

In the said circumstances, when there are no specific overtacts attributed to the 2nd petitioner, the 2nd petitioner/A2 can be granted the

relief of Anticipatory bail in the event of his arrest, subject to the following conditions:

1) The petitioner No.2/A2 is directed to surrender before the Station House Officer, Bhupalapally Police Station, Jayashankar Bhupalapally District, within a period of ten days from the date of this order. On such surrender, the said Station House Officer shall release the petitioner No.2/A2 on bail, on his executing personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each to his satisfaction.

2) On such release, the petitioner No.2/A2 shall appear before the concerned Station House Officer on every Monday, between 10.30 to 1.00 P.M. for a period of eight weeks, for the purpose of investigation.

3) The petitioner No.2/A2 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case. 6.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
