THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.9388 OF 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused No.8 in Crime.No.435 of 2023 on the file of Mancherial Town Police Station, Ramagundam, registered for the offence under Section 302, 120(B) r/w. 34 of IPC.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State and perused the record.

The case of the prosecution is that this petitioner who is arrayed as A-8 and other accused A-1 to A-7 and A-9 have conspired to kill the wife of A-1.

Accordingly, on 04.08.2023 A-3 to A-6 finding the deceased near the railway track attacked her and A-3 stabbed the deceased and A-4 beat her with a stone on her head leading to the death of the deceased.

Learned counsel appearing for the petitioner would submit that even according to the Police investigation, this petitioner was not present at the scene, his implication is on the basis of confession of other accused.

As seen from the remand report, the implication of this petitioner is on the basis of confession of accused. Admittedly, this petitioner was not present when the alleged incident had taken place. However, the allegation is that this petitioner along with others had conducted reccee of the place and also collected information regarding the movements of the deceased.

Keeping in view that this petitioner was not present at the scene, the relief of regular bail can be granted, subject to following conditions:

i) The petitioner/Accused No.8 shall execute personal bond for a sum of Rs.25,000/- (Rupees Twenty Five thousand only) with two sureties, for a like sum each to the satisfaction of Principal Sessions Judge at Mancherial.

ii) The petitioner/Accused No.8 after release shall appear before the concerned Station House Officer on every Monday for a period of eight weeks at 10.00 AM

and thereafter as and when required, for the purpose of investigation.

iii) The petitioner/Accused No.8 shall abide by the other conditions stipulated under Section 437(3) of Cr.P.C.

Accordingly, this Criminal Petition is allowed.

Miscellaneous applications, pending if any, shall stand closed.
