This writ petition is filed challenging the action of 3rd respondent in seizing the petitioner's 'Hero Passion Pro' Motor Cycle bearing Reg.No.TS 25A 3557 in connection with COR No.136/2019 of Eturnagaram Prohibition and Excise Police Station, alleging that the motor cycle is found transporting liquor bottles unauthorisedly and the action of the 2nd respondent in not releasing the said vehicle in favour of the petitioner. Learned Counsel for the petitioner submits that the lis in the writ petition is squarely covered by order dated 28.01.2019 passed by this Court in WP.No.1392 of 2019.

The same is not disputed by the learned Government Pleader for Prohibition and Excise.

In view of the same and for the reasons alike this writ petition is also disposed of granting liberty to the petitioner to submit an application before the Jurisdictional Deputy Commissioner under Section 34 of the Telangana Excise Act, seeking release of the subject vehicle. Thereupon, the said authority shall consider and pass appropriate orders on such

application, within a period of one week from the date of receipt thereof. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any pending in the writ petition, shall stand closed.
