This petition is filed under Section 482 of the Code of Criminal Procedure (for short, 'the CrPC') by the Petitioner 1 to 6(accused persons) in Cr.No.82 of 2015 of II Town Police Station, Srikakulam, registered for offences punishable under Sections 498-A IPC and 506 read with 34 of I.P.C. on the complaint of 2nd respondent, praying to quash the proceedings in said crime.
2. Heard the learned counsel for the petitioners 1 to 6 so also the learned Public Prosecutor representing State-1st respondent before ordering notice to the 2nd respondent/defacto-complainant and before admission and perused the material on record.
3. On perusal of the record, the material falls short to admit the petition under Section 482 of Cr.P.C. though the facts otherwise entitles the petitioners for regular bail.
4. In the result, the Criminal Petition is disposed of by giving liberty to the petitioners to surrender before the learned Magistrate concerned either individually or jointly, as the case may be, at their convenience and in such an event, after notice to the Asst. Public Prosecutor concerned and on hearing, the learned Magistrate shall grant bail to the petitioners on the same day, with necessary conditions. Needless to say, at best, bail stage pending investigation and final report, their presence can be dispensed with as they are stated residing at different States. Any further remedy is left open to them in the event of police filing final report and any offence taken cognizance by the Court. Consequently, miscellaneous applications, if any, pending in this Petition shall stand closed.
