THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION NO.18969 OF 2012 O R D E R :

This writ petition is filed for a writ of mandamus declaring the order passed by the 3rd respondent in proceedings No.E2/468(2)/12-knl.l, dated 21.05.2012, retiring the petitioner from service on medical grounds without providing any suitable alternate job as per provisions of Section 47 (1) of the Person with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995 (for short 'the Act'), as illegal and arbitrary.

This Court on 01.10.2012 in W.P.M.P.No.24314 of 2012 granted interim order directing the respondents to provide suitable light job to the petitioner as per the provisions of Section 47(1) of the Act.

Learned Standing counsel for respondent-Corporation on instructions submits that the aforesaid interim order has been complied with and petitioner was provided with alternative employment.

Learned counsel for the petitioner submits that the pay of the petitioner has not been protected as per Section 47(1) of the Act.

Learned Standing counsel for respondents submits that the petitioner pay will be protected as per Section 47(1) of the Act. In view of the above, the writ petition is disposed of directing the respondents to protect the pay of the petitioner as per Section 47(1) of the Act. The said exercise shall be done within a period of

eight (08) weeks from the date of receipt of copy of this order, if not already done. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any pending, in the writ petition, shall stand closed.
