HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.18827 OF 2016 ORDER:

The case of the petitioner is that her husband was assigned an extent of land admeasuring Ac.0.42 cents in Sy.No.224/2, Komarabanda Village, Kodad Mandal, Nalgonda District under the freedom fighter quota by the 2nd respondent vide patta No.9786/2000, dated 15.05.2000 and his name was also mutated in the revenue records as pattedar. Petitioner's husband expired in the year 2003 and thereafter the petitioner is in enjoyment of the said property. While so, the 2nd respondent issued a Memo dated 23.09.2015 calling upon the petitioner to submit explanation as to why the assignment granted in favour of her husband should not be cancelled, upon which, the petitioner submitted explanation on 04.10.2015. But, the respondents without passing any order have erected a board in the subject land stating that the said land is a Government land. Aggrieved by the same, present writ petition is filed.

Heard learned counsel for the petitioner and learned Assistant Government Pleader for Revenue.

Since it is stated that petitioner already filed explanation dated 04.10.2015 to the notice dated 23.09.2015, it is for the 2nd respondent to consider the same. In view of the same, the 2nd respondent is directed to consider the explanation dated 04.10.2015 submitted by the petitioner in response to the show cause notice, within a period of six weeks from the date of receipt of a copy of this order and take action in accordance with law.

With the above direction, the writ petition is disposed of. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
