THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.36857 OF 2015 ORDER:

This writ petition is filed under Article 226 of the Constitution of India for the following relief:

"to issue an appropriate writ, order or direction more particularly in the nature of "MANDAMUS" declaring the action of the Respondent No. 4 herein in withholding the pensionary benefits of the Petitioner herein as arbitrary, illegal, unjust and contrary to law and in violation of the fundamental rights guaranteed under Article 14, 19 and 21 of the Constitution of India as well as the Rules laid down under Section 4(1) of The Andhra Pradesh Gazette Part IV B Extraordinary Act 37 of 2005 and issue consequential directions to the Respondents No. 1 to 4 to forthwith release pension and other retirement benefits to the Petitioner herein with interest and penalty ."

2. Heard Sri L.Ravichander, learned Senior Counsel appearing for the petitioner and learned Government Pleader for School Education appearing for the respondents.

3. During the course of hearing, it is brought to the notice of this court that for redressal of the grievance of the petitioner, petitioner herein submitted a representation dated 04.07.2015 to the respondents and no action has been taken on the said representation and a copy of the same is also enclosed as material paper along with the writ petition.

4. Having regard the nature of controversy, the writ petition is disposed of, without expressing any opinion on the entitlement of the petitioner, directing the respondents to take appropriate action on the representation dated 04.07.2015 said to have been submitted by the petitioner herein, in accordance with law, within a period of three months from the date of receipt of copy of this order.

5. Miscellaneous petitions pending consideration, if any, in the Writ Petition shall
