THE HON'BLE SRI JUSTICE T.AMARNATH GOUD CRIMINAL PETITION No.7631 OF 2019 ORDER:

This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973 (for short, 'Cr.P.C'), is filed by the petitioner/A-1 for grant of anticipatory bail in the event of his arrest in connection with Crime No.226 of 2019 of Women Police Station, Begumpet, registered for the offences punishable under Section 498-A I.P.C and Sections 4 & 6 of the Dowry Prohibition Act, 1961.

The case of the prosecution is that the de facto complainant lodged report stating that her marriage with the petitioner/A-1 was performed on 07.08.2016 and it was an arranged marriage and her parents gave Rs.8,00,000/- towards dowry and during the wedlock, she was blessed with a child, they stayed in Eluru for a month and thereafter shifted to Secunderabad, and her husband exploited her, utilized her amounts, demanding more money created unpleasant atmosphere, subjected her to mental agony, blackmailed her saying that he would contact her DGM, where she is working as Manager in UBI, and tried to taint her image. Basing on the said complaint, the police registered the above said crime for the aforesaid offences.

Heard learned counsel for the petitioner/A-1 and the learned Additional Public Prosecutor representing the respondent/State. Perused the record.

Learned counsel for the petitioner/A-1 would submit that the petitioner is innocent of the allegations and he is nothing to do with the offences and he is apprehending arrest in the hands of the police and prayed to grant bail to the petitioner/A-1. 5.

Learned Additional Public Prosecutor opposed the grant of the bail to the petitioner/A-1.

The allegations levelled against the petitioner are grave in nature. The investigation is still in progress and hence, if the petitioner is granted anticipatory bail, there is every possibility of causing hindrance in the investigation and tampering the evidence. Hence, this Court is not inclined to grant anticipatory bail to the petitioner/A-1.

Accordingly, the Criminal Petition is dismissed. Miscellaneous petitions, if any, pending in this petition shall stand closed.
