THE HON'BLE SRI JUSTICE T.AMARNATH GOUD CIVIL REVISION PETITION Nos.2790, 2791 & 2792 of 2019 COMMON ORDER:

Since all these Civil Revision Petitions arise from a common suit, they are being disposed of by this common order. These Civil Revision Petitions are directed against the orders dated 24.09.2019 in I.A.Nos.910, 908 and 909 of 2019 in O.S.No.65 of 2009 respectively on the file of the Court of the Senior Civil Judge, Vikarabad, Ranga Reddy District (for short, the trial Court).

The petitioners herein are the plaintiffs and the respondents herein are the defendants in O.S.No.65 of 2009. During the pendency of the above suit, the petitioners filed I.A.Nos.909, 910 and 908 of 2019 to reopen the suit, recall P.W.1 and receive additional documents, respectively. The trial Court, by separate orders dated 24.09.2019 dismissed the above IAs on the ground that the petitioners did not exercise their diligence to produce the documents earlier, and for their negligence, the other party cannot be suffered. Heard.

Having regard to the facts and circumstances of the case, and on perusal of the records, to meet the ends of justice, this Court is inclined to set aside the impugned orders.

Accordingly, the Civil Revision Petitions are allowed; the orders dated 24.09.2019 in I.A.Nos.910, 908 and 909 of 2019 in O.S.No.65 of 2009 are set aside; and I.A.Nos.910, 908 and 909 of 2019 in O.S.No.65 of 2009 are allowed. No order as to costs. Miscellaneous Petitions, if any, pending in these Civil Revision Petitions shall stand closed.
