THE HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.628 of 2015 ORDER:
Heard learned counsel for petitioners and perused the Doctor Order dated 05.01.2015.
The petitioners seek to transfer D.V.C.No.25 of 2012 from the Court of learned III Additional Munsif Magistrate, Chittor, to any other Court in Chittor on the ground that after the judgment in C.C.No.247 of 2012 passed by the III Additional Munsif Magistrate, Chittor, the respondent, who is accused in that case, proclaimed as if he has got lot of influence in that Court and no one can touch him. The petitioners, thus, apprehended that they may not get justice and the petitioners herein filed Memo Crl.M.P.No.--- of 2015 before District and Sessions Judge, Chittor, seeking transfer of the case. However, the petition was returned with an endorsement that there was a direction by the High Court of A.P. in Crl.P.No.5970 of 2014 dated 12.09.2014 that the case has to be decided within two months. Challenging the said Docket Order, the present Petition is filed seeking withdrawal of D.V.C.No.25 of 2012 from the file of III Additional Munsif Magistrate, Chittor, to any other Court.
This Court is not convinced with the apprehension raised by the petitioner. Merely because some proclamation is made by some person outside the Court, without verifying the truth or falsity of the proclamation, the petitioners seeking transfer of the case is nothing but tarnishing the reputation and image of the Presiding Officer and the concerned Court. Hence, the Transfer Criminal Petition cannot be entertained on such vague and baseless allegations. Accordingly, the Transfer Criminal Petition is dismissed.
As a sequel, miscellaneous petitions, if any, pending shall stand closed.
