THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.156 of 2017 ORDER:

This writ petition is filed by the petitioner under Article 226 of the Constitution of India seeking to declare the action of the 2nd respondent in not registering the complaint of the petitioner dated 02-12-2016 as F.I.R. against respondent Nos.4 and 5 herein as illegal and arbitrary and consequently direct the 2nd respondent to investigate and register crime as F.I.R. against respondent Nos.4 & 5.

Heard the learned counsel for petitioners and the learned Assistant Government Pleader for Home and perused the material available on record. Considering the facts and circumstances of the case, the 2nd respondent is directed to register the case, if the complaint of the petitioner discloses cognizable offence.

With the above direction, the Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
