THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.24801 of 2012 ORDER:

This Writ Petition is filed seeking a direction to respondent Nos.1 to 5 and 8 to conduct enquiry in pursuance of the legal notice issued by the petitioner dated 11.02.2012 in respect of failure to collect appropriate stamp duty and penalty payable in respect of the annexure agreement dated 29.06.2005 referred in the registered sale deed dated 29.04.2011 bearing document No.669/2011 executed by respondent No.6, represented by respondent No.7. When the matter is taken up for consideration, it is represented by the learned Counsel for the respondents that a comprehensive suit is filed in O.S.No.684 of 2012 and the same is pending before the learned Chief Judge, City Civil Court, Hyderabad, wherein the issue relating to improper collection of stamp duty was also framed and it is to be decided by the said Court.

In view of the pendency of the said issue in the pending suit, this Court is not inclined to examine the request of the petitioner. The Writ Petition is, accordingly, closed. The miscellaneous petitions pending in this Writ Petition, if any, shall also stand closed. There shall be no order as to costs.
