THE HON'BLE SRI JUSTICE K.C.BHANU AND THE HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO CONTEMPT CASE No. 490 OF 2013 ORDER:
(per the Hon'ble Sri Justice K.C.Bhanu) Heard both sides.
2. To punish the respondent for willful disobedience of the interim order dated 25.07.2012 of this Court passed in W.P.M.P. No.33342 of 2011 in Writ Petition No.26988 of 2011, the present Contempt Case is filed. The order of this Court reads thus:
"Pending further orders on this application, the respondents are directed to collect the property tax in accordance with the quantum of tax assessed by the respondent No.2 vide Proceedings dt.29.10.2004."
3. A detailed counter affidavit has been filed by the first respondent stating inter alia that a mistake had occurred while operating computer by the computer operator with regard to demand to pay the amount of tax to an extent of Rs.22,76,832/- with effect from 1995 and that immediately after noticing the said mistake, the Corporation rectified the same by note order dated 30.03.2013 duly instructing the computer operator to implement the order passed by this Court dated 25.07.2012, and in pursuance of the same, property tax of the petitioner was rectified at Rs.231/- by deleting the amounts mentioned in the demand notice dated 30.10.2012 and the same was intimated to the petitioner orally, and that in pursuance of the same, the petitioner has been paying the property tax at Rs.231/- and the same has been accepted by the Corporation.
Therefore, there is no willful disobedience of the interim
order of this court. It is only a mistake crept in while operating computer.
4. The Contempt Case is, accordingly, closed. No costs. Miscellaneous Petitions pending, if any, in the Contempt Case shall stand closed.
