HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 40446 of 2012 ORDER:

Heard learned counsel for the petitioners and Government Pleader for Revenue. With the consent of both the parties, the main writ petition is heard at the admission stage itself.

The present writ petition came to be filed seeking issuance of writ of mandamus declaring the inaction of the respondent Nos.2 and 3 in not restoring the petitioners house site admeasuring Ac.0.25 cents situated in Sy.No.105-2A of Kirikera Village, Hindupur Mandal, Anantapur District, in pursuance of the report of respondent No.2 in Rc.No.510/2012 (B), dated 10.07.2012 and the endorsement of respondent No.1 dated 23.07.2012 and 08.10.2012, as illegal, arbitrary and unjust; and consequently direct the respondents to restore the petitioners house site.

Though the petitioners claimed various reliefs, the learned counsel for the petitioners restricts his prayer seeking a direction to respondent No.1 to consider the representation, dated 23.07.2012 made by the petitioners. Without going into the merits of the case and having regard to the facts and circumstances of the case, the writ petition is disposed of directing respondent No.1 to pass orders on the representation dated 23.07.2012 made by the petitioners, in accordance with law, as early as possible, preferably within a period of twelve (12) weeks from the date of receipt a copy of this order, if the same is still pending consideration. No order as to costs. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
