HON'BLE SRI JUSTICE A.RAJASHEKER REDDY TRANSFER CIVIL MISCELLANEOUS PETITION No.637 of 2015 ORDER:

This petition is filed to transfer H.M.O.P.No.1399 of 2015 pending on the file of Judge, Family Court, L.B.Nagar, Ranga Reddy District to the file of Judge, Family Court, Nalgonda.

2. Originally the respondent herein filed the aforesaid O.P. against the petitioner herein for grant of divorce.

3. The marriage of the petitioner with the respondent was performed on 13.12.2004 as per Hindu rites and customs. The marriage was consummated and they were blessed with a female child. Thereafter, the respondent ill-treated and harassed the petitioner for additional dowry. Due to the said harassment, the petitioner went to her parents house at Nalgonda. Thereafter, the respondent filed the aforesaid O.P. Petitioner filed a Criminal Case under Section 498-A IPC and maintenance case under Section 125 Cr.P.C. against the respondent.

4. In spite of service of notice, none appears for the respondent.

5. The petitioner is residing at Nalgonda and she is depending upon the earnings of the parents. O.P.No.1399 of 2015 is pending on the file of Judge, Family Court, L.B.Nagar, Ranga Reddy and it is difficult to the petitioner to travel from Nalgonda to Ranga Reddy District in connection with O.P.No.1399 of 2015. It is stated that the respondent is doing private job and earning an amount of Rs.30,000/- per month.

6. It is not in dispute that in connection with the Criminal Case and the maintenance case filed by the petitioner, the respondent is attending the Court at Nalgonda.

Therefore, if O.P.No.1399 of 2015 pending on the file of Judge, Family Court, L.B.Nagar, Ranga Reddy District is withdrawn and transferred to Judge, Family Court, Nalgonda, it will not be difficult to the respondent to attend the Court at Nalgonda District.

7. Accordingly, the Transfer Civil Miscellaneous Petition is allowed withdrawing O.P.No.1399 of 2015 from the file of Judge, Family Court, Ranga Reddy District and transferring the same to the file of Judge, Family Court, Nalgonda District. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this petition shall stand closed.
