HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.4677 OF 2017 ORDER:

This writ petition is filed challenging the notice issued by the 7th respondent-Tahsildar, Gummadidla Mandal, Sanga Reddy District vide Lr.No.B/7/2016-1 dated 25.01.2017. Learned counsel for the petitioner submits that the impugned proceedings are in the form of 'notice', however, in the said notice, there is a direction to the petitioner to remove the so-called objectionable constructions within the limits of Buffer Zone of Rayan Cheruvu, Jinnaram Mandal. He further submits that while conducting the alleged survey, the petitioner was not given opportunity and further the impugned notice could not have been passed by the respondent without issuing prior notice to the petitioner.

Learned Assistant Government Pleader for Revenue submits that the impugned notice may be treated as show cause notice and the petitioner shall submit explanation to the said notice. In view of the submissions made, it is open to the petitioner to submit explanation to the impugned notice within a period of four

(04) weeks from today by raising all the objections available to him under law. On receipt of the explanation of the petitioner, the 7th respondent shall consider the same and pass appropriate orders, after giving opportunity of hearing to the petitioner, in accordance with law. Till such time final orders are passed on the explanation of the petitioner, all further proceedings pursuant to the impugned notice shall stand stayed.

With the above direction, the writ petition is disposed of. There shall be no order as to costs. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
