Heard the counsel for the petitioners and the Government Pleader for Revenue appearing for respondents 1 to 4.
2. Petitioners had questioned order dt.05.02.2016 passed by respondent No.4 by filing an appeal before respondent No.3 under the provisions of A.P. Water, Land and Trees Act, 2002 ("WALTA" for short). Petitioners have also filed a stay application in the appeal, seeking stay of execution of the order passed by respondent No.4.
3. Counsel for the petitioners contends that respondent No.3 is not passing any orders in the stay application filed along with appeal by the petitioners, challenging the orders of respondent No.4 and there is a threat of respondent No.4 seizing the bore well pursuant to his orders dt.05.02.2016.
4. Government Pleader for Revenue appearing for respondent No.3 states that respondent No.3 will consider and dispose of the appeal, within twelve (12) weeks from the date of receipt of a copy of this order.
5. Therefore, the writ petition is disposed of directing respondent No.3 to dispose of the appeal filed by the petitioners on 11.03.2016 challenging the order dt.05.02.2016 passed by respondent No.4, within twelve
(12) weeks from the date of receipt of a copy of this order. Pending disposal of the said appeal, the order passed by respondent No.4 shall remain stayed. There shall be no order as to costs.
5. Consequently, miscellaneous petitions pending, if any, shall stand dismissed.
