After some arguments, counsel appearing on behalf of the petitioner seeks permission to withdraw the revision petition with liberty to file a petition before the Court below taking the primary objection of jurisdiction as defined in Section 19 of the Hindu Marriage Act, 1955. Permission with liberty as prayed for, is granted and the revision petition is dismissed as withdrawn. No costs. I hereby make it clear that if the petition is filed by the petitioner herein on jurisdiction, the said petition shall be decided before passing order in the petition filed under Section 9 of the Hindu Marriage Act.
