HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.33987 OF 2016

O R D E R

The case of the petitioner is that he made an application on 16.06.2016 before the 2nd respondent seeking permission, for conversion of the subject property from agricultural land to Nonagricultural purpose in terms of Section 4 of the Andhra Pradesh Agricultural Purpose Act, 2006 who in turn referred the application to the 3rd respondent for enquiry and submission of report. The 3rd respondent after due enquiry submitted a report dated 31.08.2016 to the 2nd respondent stating that there are civil disputes pending in respect of subject property. In spite of filing of the report by the 3rd respondent, the 2nd respondent did pass any orders on the application made by the petitioner. Aggrieved by the same, the present writ petition is filed. Learned counsel for the petitioner submits that pending of civil suits has no bearing on the application submitted by the petitioner.

Learned Assistant Government Pleader for Revenue submits that civil litigations are pending in respect of the subject property. Since the application submitted by the petitioner on 16.06.2016 is stated to be pending before the 2nd respondent, without expressing any opinion on merits, the 2nd respondent is directed to dispose of the same in accordance with law within a period of six (06) weeks from the date of receipt of copy of this order.

With the above direction, the writ petition is disposed of. There shall be no order as to costs. As a sequel, miscellaneous petitions pending if any, shall stand closed. ____________________________ A.RAJASHEKER REDDY,J Date: 14.10.2016 dv
