HONOURABLE SRI JUSTICE T. VINOD KUMAR WRIT PETITION No.26173 OF 2019 ORDER (ORAL) :

The present writ petition is filed seeking a Writ of Mandamus to declare the action of the first respondent in not passing orders either in the revision or the stay application filed therein by the petitioner against the order, dated 07.10.2019, in C.M.A.No.35 of 2018 passed by the second respondent, as illegal and arbitrary.

2. Heard learned counsel for the petitioner and learned Government Pleader for Social Welfare.

3. Perusal of the record discloses that the petitioner has filed a revision before the first respondent along with an application for stay on 29.10.2019 and it is stated that the same is pending consideration by the first respondent.

4. Having regard to the facts and circumstances of the case, since the appeal is already filed and pending consideration before the first respondent, ends of justice would be met, if a direction is given to the first respondent to consider and dispose of either the revision or the stay application filed therein against the order of the second respondent, protecting the interest of the petitioner in the meanwhile.

5. Hence, without expressing any opinion on the merits of the matter, the writ petition is disposed of, directing the first respondent to consider and dispose of either the stay application, or the revision, on

its own merits, and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order. Till then, the petitioner shall not be dispossessed from the land in question. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order.
