HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.1670 OF 2013 ORDER:

In this petition filed under Section 482 Cr.P.C., the petitioners/A1 to A3 seek to quash the proceedings against them in C.C.No.154 of 2012 on the file of VII Special Magistrate, Erramanzil, Hyderabad (now pending before VI Special Magistrate, Hyderabad and numbered as C.C.No.445 of 2014), registered for the offence under Section 138 of N.I.Act.

When the matter came up for hearing, learned counsel for petitioners, without insisting for quashment of the proceedings, would submit that the petitioners inter alia have taken the plea of lack of jurisdiction by the trial court and they may be permitted to take the said plea before the trial court along with other pleas legally permissible to them and this petition may be closed.

Recording the above submission and granting the liberty as prayed for, this criminal petition is closed. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
