Heard the Assistant Government Pleader for Home. The petitioner complains against the alleged interference by respondent No.2 in the construction activity as illegal, arbitrary and unconstitutional.

The 2nd respondent filed counter affidavit and has explained the circumstances under which petty cases have been registered under the City Police Act and how steps taken to prevent nuisance by the construction activity undertaken by the petitioner at midnight. After perusing the material on record, this Court is of the view that the interference, if any, in to the construction activity of petitioner is pursuant to and in terms of petty cases registered against the petitioner and the writ remedy to interdict at that stage is not made out. Hence, the writ petition fails and dismissed. No order as to costs.
