OFFICE NOTE 17.04.2026 SKS, J I.A.No.1 of 2026 This application is filed under Section 439 (1) (b) of the Cr.P.C. seeking to modify/relax the specific condition No.7 imposed by this Court vide order, dated 28.08.2025 in Cr.P.No.10528 of 2025 and consequently to return the petitioner's passport bearing No.Y2624210 and allow the petitioner to travel outside India on such terms and conditions that may be imposed by this Court.
Heard Sri K.Siddharth Rao, learned counsel for the petitioner-accused No.1 and Sri M.Ramachandar Reddy, learned Additional Public Prosecutor, appearing for the respondent-State.
Learned counsel for the petitioneraccused No.1 would submit that the petitioner filed an application before the learned trial Court seeking interim custody of the petitioner's passport to enable him to travel to Singapore to visit and assist his daughter, who has secured admission in a
reputed International College in Singapore.
The petitioner also filed relevant documents including proof of admission and proposed travel ticket. But, the learned trial Court dismissed the application, as such the petitioner requested this Court to relax the said condition as he has been cooperating with the investigating officer from the date of bail granted by this Court and hence he prays to relax the condition No.7.
On the other hand, learned Additional Public Prosecutor opposed the same and filed counter requesting the Court to dismiss the petition as the presence of the petitioner is very much required for investigation and charge sheet is also not yet filed in this case and hence, he prays to dismiss the petition.
Considering the submissions made by learned counsel for the petitioner and perusal of the material on record, the request of the petitioner to release his passport and to permit him to travel Abroad for a specific period i.e., for a period of three months staring from 1st May to 31st July, 2026 to visit the children is hereby ordered.
Accordingly, condition No.7 imposed by this Court vide order, dated 28.08.2025 in Crl.P.No.10528 of 2025 is hereby relaxed and the petitioner is permitted to travel Abroad for
a limited period of three months as stated above. The learned trial Court is directed to return the passport pertaining to the petitioner by imposing appropriate conditions. It is made clear that after return from the Abroad, the petitioner shall redeposit the passport before the learned trial Court.
The other conditions imposed by this Court shall remain unaltered.
With the above directions, the application is ordered.
