THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.6461 OF 2016 ORDER:

This Criminal Petition is filed under Section 482 of Code of Criminal Procedure (Cr.P.C.) seeking to relax the bail condition imposed while granting anticipatory bail in Crl.M.P.No.176 of 2016 in crime No.17 of 2016 by the Principal District and Sessions Judge, Srikakulam, arising out of offences under Sections 326, 324 read with Section 34 IPC.

Heard and perused the records.

Learned counsel for the petitioners submits that the Court below while granting anticipatory bail to the petitioners, erroneously directed the petitioners herein to deposit Rs.50,000/- (Rupees fifty thousand only) each in the name of the Court Deposit towards victim compensation. He further submits that the petitioners are not in a position to deposit the said amounts and as such, prays this Court to relax the condition.

Considering the facts and circumstances, this Court is inclined to relax the said condition and hence, the said condition of depositing Rs.50,000/- (Rupees fifty thousand only) each by the petitioners is hereby set aside.
