HON'BLE SRI JUSTICE U. DURGA PRASAD RAO Writ Petition No.28724 of 2008 ORDER:

The petitioner seeks a Writ of Mandamus declaring the inaction of respondent in considering the clam of the petitioner for grant of pension under Swatantra Sainik Samman Pension Scheme, 1980 as illegal, arbitrary, contrary to scheme and violative of principles of natural justice and consequently direct the respondent to grant pension to the petitioner in the light of communication Lr.No.112/2376/85 FF (HC) dt.27.11.1997. 2) This Court on 30.12.2008 in W.P.M.P.No.37597/2008 passed an interim order directing the respondent to consider the claim of the petitioner for grant of pension.

3) When the matter came up for hearing, learned counsel for petitioner by producing the copy of the letter dated 02.09.2009 sent by the Under Secretary to the Government of India to the petitioner, would submit that pursuant to the interim order dt.30.12.2008, the said letter was sent by the respondent to the petitioner wherein the respondent requested the petitioner to provide a copy of the application along with prescribed documents in support of his claim through the Government of Andhra Pradesh (now the Government of Telangana) for further action regarding his claim. Learned counsel would submit that in view of the said letter addressed by the respondent, the Writ Petition may be closed giving liberty to the petitioner to submit his application along with the necessary

documents to the State Government for verification and transmission to the respondent for taking appropriate action thereon. 4) Learned Assistant Solicitor General appearing for respondent reported no objection for this course.

5) In view of the above respective submissions, this Writ Petition is disposed of giving liberty to the petitioner to submit his application along with the prescribed documents in support of his claim to the Government of Telangana, for verification and transmission to the respondent for consideration and passing appropriate orders in accordance with law. No costs.

As a sequel, pending miscellaneous petitions, if any, shall stand closed.
