THE HONOURABLE SMT JUSTICE K. SUJANA CRIMINAL PETITION No.10553 of 2025 ORDER:

Seeking the Court to enlarge the petitioner who is arrayed as accused No.1 in Crime No.336 of 2025 of Suraram Police Station, Hyderabad, on pre-arrest bail, the present Criminal Petition is filed.

The brief facts of the case are that on 18.06.2025, the de facto complainant, wife of the deceased lodged a written complaint at PS Suraram stating that her husband, had been in a business partnership for seven years with Mr. Satyanarayana Goud (Satish) at Vinayaka Industries, Jeedimetla. She alleged that for the past four years, Mr. Goud had been evading payment of her husband's rightful share in the business, and for two months prior to the incident, no dues were paid at all. The deceased had expressed suicidal thoughts to his family, and despite their counseling, he went to the penthouse of their residence on the morning of 18.06.2025 and hanged himself using a towel. The incident was witnessed by a neighbour, and the deceased was rushed to Malla Reddy Hospital, where he was declared dead. A suicide note recovered from his pocket named Satyanarayana Goud, Phani

Kumar, and a duty person as responsible for his death due to mental harassment and non-payment of Rs.30,00,000/-. The note also contained personal apologies and instructions regarding his children's education and pending dues.

Heard Sri S. Sudarshan, learned counsel appearing on behalf of the petitioner as well as Sri Syed Yasar Mamoon, learned Additional Public Prosecutor appearing on behalf of the respondent - State.

Learned counsel for the petitioner submitted that the allegations levelled against the petitioner are vague and baseless, and that the petitioner is innocent of the offences alleged in the complaint. He further submitted that the petitioner is neither a partner nor an employee of the firm, i.e., Vinayaka Industries. Therefore, he prayed the Court to grant pre-arrest bail to the petitioner by allowing the present criminal petition. 5.

On the other hand, learned Additional Public Prosecutor would submit that there are clear allegations against the petitioner which amounts to abetment of committing suicide. At this stage, granting of pre-arrest bail to the petitioner does not arise. Therefore, he prayed the Court to dismiss the criminal petition.

In the light of the submissions made by both the learned counsel and upon a perusal of the material available on record, it appears that the petitioner is arrayed as accused No.1, and the petitioner along with other persons cheated the deceased as such she committed suicide. Considering the facts and circumstances of the case and the judgment of the Hon'ble Supreme Court in Criminal Appeal No.221 of 2025, this Court deems it fit to grant pre-arrest bail to the petitioner, subject to the following conditions: i.

The petitioner shall surrender before the Station House Officer, Suraram Police Station, Cyberabad Commissionerate, within two weeks from today, and on such surrender, the said Station House Officer shall release him on bail on executing a personal bond for Rs.25,000/- with two sureties, for the like sum each.

ii.

The petitioner shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case.

iii.

The petitioner shall appear before the concerned Investigating Officer on every Monday between 09:00 A.M., and 05:00

P.M., till the filing of the charge sheet and thereafter, as and when required.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
