THE HON'BLE SRI JUSTICE A. SHANKAR NARAYANA C.C.C.A.No.121 OF 1998 JUDGMENT:

Learned counsel for the appellant earlier filed Memo, dated 14.07.2016, reporting no instructions. Pursuant thereto, Registry was directed to issue notice to the appellant. An endorsement is made under the 'Office Note' that notice was sent to the appellant on 05.08.2016, but there is no endorsement as to whether service of notice was effected or not. Even otherwise, when the appellant, who was, in fact, aged 70 years when the appeal was filed in the year 1998, as per the cause title, is not turning up or not evincing any interest, certainly, there is no reason to adjourn the matter.

Therefore, the instant appeal is dismissed for nonprosecution. Miscellaneous Petitions, if any, pending in this appeal, shall stand closed. There shall be no order as to costs.
