THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.15603 of 2016 ORDER:
The petitioner claims to be the owner of the tractor bearing registration No.AP 30 V 3528, having purchased the same on 27.11.2015. The transfer in favour of the petitioner was also affected by the second respondent. While so, the 3rd respondent seized the vehicle on 16.02.2016 basing on the report furnished by the Tahsildar. The third respondent claimed seizure of the vehicle under Section 207 of the Motor Vehicles Act, 1988. The petitioner got issued a notice through his counsel on 26.03.2016 for release of the vehicle and when the respondents 2 and 3 did not take action for release of the vehicle, the present writ petition was filed.
2. In view of the registered notice got issued by the petitioner through his counsel on 26.03.2016, this Court is not inclined to examine the merits of the case, but directs the 3rd respondent to take appropriate action in accordance with law by considering the said representation and pass appropriate orders within a period of one week from the date of receipt of a copy of this order.
3. The Writ Petition is disposed of accordingly. There shall be no order as to costs. As a sequel, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
